Terms of Use

1. Accounts

You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old and able to form a binding contract. One account may act in multiple capacities (for example, running your own projects and collaborating on another company’s projects). If you act for a business, you must have authority to do so. Keep your account and linked phone numbers current, and report suspected unauthorized access.

2. Acceptable use

You agree not to misuse the Service, including by attempting to access data you are not authorized to access, interfering with normal operation, uploading unlawful or infringing content, or using the Service to violate any law or the rights of others. We may suspend or terminate accounts that violate these Terms.

3. Your content

You retain ownership of the content you submit (projects, documents, messages, and similar). You grant us a limited license to host, process, and display that content solely to operate and improve the Service. You are responsible for the content you submit and for having the rights to submit it.

Project information is shared according to project membership, permissions and your sharing choices. Do not upload information you are not authorized to share. Our Privacy Policy explains processing by us and service providers. This draft does not expand permission to use previously collected information.

4. Leads and proposals

The Service may surface property and project leads sourced from us or from third-party partners, and may let you submit proposals in response. We do not guarantee the accuracy, completeness, or availability of any lead, and submitting a proposal does not create a contract between you and any property owner or partner. Any resulting engagement is solely between the parties to it.

5. Subscriptions and payments

Platform subscription charges are separate from construction invoices and payments between project participants. The pricing page describes the standard per-project and additional-person charges. Review the amount, billing interval and applicable charges before confirming a purchase. Subscriptions use recurring billing. Company administrators can manage an existing subscription through the billing settings and Stripe billing portal. Review the cancellation effective date there; contact us if you need assistance.

Payments facilitated through Stripe are also subject to its applicable terms. Contact sm@eit.care about billing errors, cancellation or refund requests. Stopping use of the Service does not itself cancel a subscription, and cancellation is separate from an account-deletion request. Nothing in these Terms removes rights you have under applicable law.

6. AI, estimates and project decisions

AI chat, summaries, image or document text extraction, and phone answers can contain mistakes or omit context. Availability depends on the feature and account configuration. Estimates, measured quantities, schedules and recorded financial figures require review against source documents, actual site conditions and qualified professional advice. They are not guarantees of cost, completion, code compliance, safety or construction quality.

GCMGM is a communication and project-tracking tool, not your contractor, architect, engineer, accountant or legal adviser. Project participants remain responsible for their contracts, approvals, permits and work. Recorded approval history does not by itself establish legal enforceability or prove that a person had authority. Keep appropriate independent copies of important records. Do not use the Service for emergencies; call 911 for an emergency in the United States.

7. Read-only AI phone access

Where enabled, the AI phone assistant answers questions using information the admitted account is allowed to access. Linking a number does not itself approve phone access. Approved ordinary callers use Caller ID without a PIN on each call; super administrators must also complete the administrator PIN check. Caller ID is not spoof-proof identity. Tell us promptly about a lost, shared or reassigned number so access can be reviewed or revoked.

This phone route does not authorize business changes or payments. Calls use speech recognition, AI and speech-generation services as explained in the Privacy Policy. You can use the dashboard instead of the phone assistant. These Terms are not a substitute for any required call-specific notice or consent.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. These exclusions apply only to the extent permitted by law. No permanent availability or storage guarantee is made.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amounts you paid us in the twelve months before the claim. Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Certain provisions survive termination, including ownership, disclaimers, and limitation of liability.

11. Changes

We may update these Terms from time to time. Published revisions will identify their effective date. For material changes, we will provide the notice and obtain any agreement required by applicable law. A revised page alone does not authorize a new use of previously collected personal information.

12. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any legal action or proceeding arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Harris County, Texas. Each party consents to the personal jurisdiction and venue of those courts, except where applicable law requires otherwise. Mandatory consumer protections remain unaffected.

13. Optional SMS notifications

GCMGM.com offers optional automated verification texts and account or project alerts, such as new messages, invitations and change-order updates. To enroll, open Settings → Notifications, choose Set up texts, enter a mobile number you control, give SMS consent and verify the code. Then choose the alerts you want under Choose alerts. Creating an account or adding a profile or phone-assistant number does not enroll you. SMS consent is not required to use the Service or purchase a subscription.

Message frequency varies with verification requests, selected alerts and account activity. Message and data rates may apply. Texts contain a short event label and links; sign in to view the details. Delivery can be delayed, filtered or unavailable, and is not guaranteed. Do not rely on SMS for emergencies, safety warnings or time-critical decisions.

Turn off an individual text alert under Choose alerts, or choose Turn off texts to remove the active notification number. Messages already submitted to a carrier may still arrive. Changing a number requires new consent and verification; saved alert choices apply after verification. These choices are separate from email, in-app and phone-assistant settings. Text replies are not handled by the platform; use Settings to manage texts or contact sm@eit.care for help or an opt-out request. Our Privacy Policy describes SMS data and delivery providers.
